Otodata Wireless Network Inc. values your privacy and is committed to protect the personal information of the users of the GPSIRIS unit (the “Products”) and the associated mobile application (the “App”) and associated services and web portal (together with the App, the “Services”). In this Privacy Policy, “Otodata”, “we”, “us” or “our” means Otodata Wireless Network Inc.

To better protect your privacy, we provide this Privacy Policy which explains how we collect, use, share and store your personal information, and how this personal information can be accessed and corrected when necessary.

By using our Products and/or Services or otherwise by interacting with us, you consent to this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not engage in any of these activities.

a) What Information Do We Collect?

The types of personal and other information we may collect about you are primarily from four sources: (a) information you provide; (b) third party information collected; (c) information automatically collected; and (d) information from other sources.

b) Information You Provide

Otodata collects personal information about you when you register to become a user of our Products and/or Services, and when you otherwise transmit such information to us via the Internet (including partner websites) or by email. For instance, to maintain your account we collect and store in a database your name, nickname(s), addresses, email addresses and telephone numbers.

Further, in order to provide the Services to you, Otodata will collect localization data based on your use of the Products and/or Services.

c) Third Party Information Collected

If third parties use the Products and/or Services through your user account, you shall ensure that they only use the Products and Services in compliance with the law and this Privacy Policy. You are responsible and liable for all activities of users of your user account and/or the Products, including all access to or use of the Services. Without limiting the foregoing, it is your responsibility to: (i) inform other users of your user account and/or the Products that their access to and use of the Products and/or Services is subject this Privacy Policy; and (ii) ensure that such other users comply with this Privacy Policy.

You hereby represent and warrant that you will communicate the terms of this Privacy Policy in advance to such users and that you shall ensure that they agree with the terms of this Privacy Policy.

d) Information Automatically Collected

Otodata automatically receives certain types of information, some of which may be associated with personal information, when you visit our websites or use our Products or Services.

(i) Information Related to Your Location or Other User Content. So long as you have the App and/or the Services installed on your wireless device, and in your vehicle, we record your location, as well as the location of any GPSIRIS unit located and installed in your vehicle. We maintain a database with these locations, and keep such information for as long as a business need exists, to the extent permitted by applicable law, particularly to improve our Products and Services, and to provide other features that may enhance your service capabilities, functions, and your user experience. We may periodically receive your current location from the GPS hardware and/or GPS technology associated with your wireless device for the purpose of providing enhanced services.

(ii) Cookies and Similar Technologies on the Website and App. We may employ browser cookies or similar technologies to identify the computer, mobile device, or some of our services and record your preferences and other data. We use cookies or similar technologies to evaluate how our websites, devices or applications are used and to provide continuous improvement to our Products and Services, make recommendations, and complete transactions you request. Cookies may be stored locally on mobile devices or on computer servers operated or controlled by third party vendors of Otodata. In addition, when you visit our website, our systems automatically collect your IP address and the type of browser that you use. We may employ third-parties to place advertisements about our Products and Services on other websites. The use of cookies or other similar technologies by such third parties is governed by their privacy policies. You may limit the automatic collection of certain information by our website by disabling the cookies using your browser options. Please be aware that disabling cookies may prevent you from using specific features on our websites, such as maintaining an online account.

(iii) Other Information. When using our website or App, we may collect and store information about your hardware device, installed software (e.g. operating system version), IP address, mobile equipment model and mobile telecommunications provider.

 

e) Information From Other Sources

Otodata may obtain information about you from outside sources and add to it or combine it with your personal information. For example, we may collect demographic and marketing data about you from third parties for marketing research and analysis to improve our Products and Services, or collect information from other vendors that promote and distribute our Products and Services through their own brands.

 

f) How Do We Use Your Information?

Otodata may use your personal information in a number of ways, including:

  • to provide the Products and Services you have purchased or requested;

  • to support your Products and Services;

  • to communicate with you about your Products and Services;

  • to access, store and analyze your personal information so that you may enjoy your Products and Services;

  • to install and configure changes and updates to your Services;

  • to follow up on any question and request for assistance or information;

  • to authenticate users of our Products and Services;

  • to communicate localization information obtained in relation to the Products and Services to other users of the Services in order to facilitate the search and tracking of your Products;

  • to evaluate the performance and safety of our Products and Services;

  • to develop, improve and optimize the quality of our Products and Services;

  • to understand your needs and preferences, and to assess your level of satisfaction with our Products and Services;

  • to operate our website and App and digital properties and customize the content;

  • to verify your eligibility for certain programs or benefits;

  • to comply with legal requirements;

  • to prevent and detect fraud or misuse of your Products and Services;

  • to maintain internal records;

  • to send you bulletins on our Products and Services, news and events and to follow up on our offers, promotions or contests, to the extent permitted by applicable law; and

  • for marketing purposes, to the extent permitted by applicable law.

 

g) With Whom Do We Share Your Information?

Internally, only employees who need to access to your personal information for the execution of their duties will have access to it. We may also share your personal information, including:

  • within the Otodata family of companies, which includes parents, corporate, affiliates, subsidiaries, business units and other companies that share common ownership;

  • with select business partners;

  • with third-party service providers working on behalf of Otodata;

  • a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Otodata’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by Otodata about our users is among the assets transferred, as long as, the party acquiring such personal information agrees to be bound by the terms of this Privacy Policy;

  • to other users of the Services in order to facilitate the search and tracking of your Products;

  • with your mobile device and/or wireless service provider; and

  • with law enforcement and governmental entities when required by law.

 

h) How Do We Store Your Information?

Your personal information is stored on servers hosted in Canada.

Otodata has implemented various physical, electronic and procedural safeguards to protect the confidentiality and security of personal information under our control. For instance, we limit access to your personal information to authorized Otodata personnel.

While we maintain a multitude of security measures to prevent unauthorized access to or disclosure of your personal information, no security measures are absolute or wholly guaranteed. We will make reasonable attempts to notify you if it determines there were unauthorized acts by third parties that violate the law or this policy, or other security breaches, or where otherwise required by law.

Otodata will maintain your personal information for as long as a business need exists, or as required by applicable laws, regulations, or government orders.

i) Right to Access and Correct

On written request and subject to proof of identity, you may consult the personal information that we have disclosed, and ask that any necessary corrections be made, where applicable, as authorized or required by law.

However, to make sure that the personal information we maintain about you is accurate and up to date, please inform us immediately of any change in your personal information.

j) Update

Our Privacy Policy may be periodically amended to reflect changes made to our practices. If we make any such change, we will post a notice to that effect on our website in order to inform you of the date on which these amendments will come into effect. We therefore invite you to consult our website from time to time to stay informed of the latest developments. Continued use of our Products and/or Services after the effective date will be construed as an acceptance of these changes on your part.
